Scorched Earth Records (“we”, “us”, “our”) is an Australian underground metal label and distro. This policy explains what personal information we collect through scorchedearthrecords.com.au, why we collect it, who we share it with, and the choices you have.

By using this website or placing an order, you accept the practices described here. If you do not agree, please do not use the site.

1. Who we are

Scorched Earth Records is operated by Andrew MacLean (ABN 41 971 501 584). You can contact us at any time at [email protected].

2. What we collect

Order and account details. When you place an order or create an account, we collect your name, email address, phone number, billing address, delivery address, the items you ordered, and your order history. If you create an account, we also store your login details. Your password is stored in encrypted form and we cannot read it.

Payment details. We do not store your full card details on our servers. Payments are processed by Stripe and Paypal, who handle your payment information under their own privacy policies. We receive confirmation of whether the payment succeeded, a transaction reference, and the details needed to manage refunds.

Enquiries and trade requests. If you contact us through a form or by email, including release enquiries and trade list requests, we collect the information you provide and keep a record of the conversation.

Technical and usage information. When you visit the site, we and our service providers automatically collect your IP address, browser and device type, the pages you view, the page that referred you, and your approximate location. This comes from server logs, our security and performance provider, and our analytics tool.

3. How we use your information

We use your information to:

  • process, pack and deliver your orders
  • send order confirmations, shipping updates and customer service messages
  • respond to your enquiries and trade requests
  • handle returns, refunds and disputes
  • protect the site and our customers from fraud, spam and attacks
  • understand how the site is used so we can fix problems and improve it
  • keep the records we are legally required to keep, including tax and accounting records
  • send you news and release announcements, but only if you have asked us to

We do not sell your personal information. We do not use it to build advertising profiles.

4. Who we share it with

We share information only with the providers we need to run the store, and only as much as they need to do their job.

  • Payment providers process your payments.
  • Australia Post receives your name, delivery address, and where needed your phone number and email address, to deliver your order and provide tracking.
  • ZeptoMail delivers our order and account emails.
  • Cloudflare provides security, performance and DNS for the site.
  • Vultr hosts the website and its database on servers in Sydney.
  • Backblaze stores encrypted backups of the site, which include order and customer records.
  • PostHog provides our website analytics.
  • Wordfence provides security scanning and firewall protection for the site.

Where we also sell through marketplaces such as Discogs and eBay, orders placed there are handled under the privacy policy of that marketplace, and we use the buyer details they give us to fulfil the order.

We may also disclose information where required by law, by a court, or by a government or law enforcement authority, or where needed to protect our rights or the safety of others.

5. Disclosure outside Australia

Some of our providers store or process data outside Australia, including in the United States. When you order from overseas, your delivery details are also passed by Australia Post to international postal carriers and customs authorities in order to deliver your parcel. We take reasonable steps to make sure our providers handle your information in a way that is consistent with this policy.

6. Cookies and analytics

We use cookies and similar technologies for three purposes.

Essential cookies. These keep your cart working, remember your login, and secure the checkout. The site cannot work properly without them.

Security cookies. Our security and performance providers may set cookies to detect bots and attacks.

Analytics. We use PostHog to see which pages are visited, how people move through the store, and where problems occur. This information is used in aggregate to improve the site.

You can block or delete cookies in your browser settings. If you block essential cookies, parts of the store, including the cart and checkout, will not work.

7. Marketing

If you subscribe to our mailing list or tick a marketing option at checkout, we will send you news about new releases, restocks and label updates. You can unsubscribe at any time using the link in any email, or by contacting us. Unsubscribing from marketing does not stop order and account emails.

8. Security

We take reasonable steps to protect your information, including encrypted connections across the site, a web application firewall, access controls, regular software updates, and encrypted backups. No online system is completely secure, so we cannot guarantee absolute security. If a data breach is likely to cause you serious harm, we will notify you and any regulator as required by law.

9. How long we keep your information

We keep order and financial records for at least five years to meet our tax and accounting obligations. Enquiries and account details are kept for as long as they are needed for the purpose they were collected, and are then deleted or de identified. Backups are rotated on a regular schedule, so deleted information may remain in older backups for a limited time before it is overwritten.

10. Access, correction and deletion

You can ask us for a copy of the personal information we hold about you, ask us to correct it, or ask us to delete it. Email [email protected] and we will respond within a reasonable time, normally within 30 days. We may need to verify your identity first. We may decline a request where the law allows or requires us to keep the information, for example order records needed for tax purposes, and if so we will tell you why.

11. Customers outside Australia

If you are in the European Economic Area, the United Kingdom or another region with its own privacy laws, you may have additional rights, such as objecting to certain processing or receiving your data in a portable format. Contact us and we will consider your request in line with the law that applies to you.

12. Links to other sites

Our site links to other websites and services, including Bandcamp, Discogs and Facebook. We are not responsible for their privacy practices, and we encourage you to read their policies.

13. Complaints

If you are unhappy with how we have handled your information, please contact us first at [email protected] and we will investigate and reply promptly. If you are not satisfied with our response, you can contact the Office of the Australian Information Commissioner at oaic.gov.au or on 1300 363 992.

14. Changes to this policy

We may update this policy from time to time. The current version will always be published on this page with the date it was last updated. If we make a significant change, we will take reasonable steps to let you know.
